What is an Association Health Plan?
Association Health Plans (AHPs) are group health insurance plans offered to the members of an association through a Multiple Employer Welfare Arrangement.
AHPs typically provide lower cost and/or better benefits to an association’s combined membership than a single small employer can provide when it negotiates directly with the insurer. Because the membership is combined, the insurer can take advantage of the regulations in the large group insurance market which provide more flexibility and lower costs to the insurer, passing those savings on to your membership.
Why should an association provide AHPs?
Associations that successfully implement AHPs often see their membership grow 20%-30% within the first year of operation and experience better long-term membership stability during down-turns in the economy.
One AHP Experts’ client that implemented an association health plan experienced a 30% increase in membership in the first year of operation. Another that began offering AHPs had to double its staff to handle the influx of accreditation requests from applying members.


What is a Multiple Employer Welfare Arrangement (MEWA)?
A MEWA is a group of employers that work together with a sponsoring association to provide employee benefits to its member organizations. Often the association sets up a trust to manage the plan.
MEWAs are structured under the Employee Retirement Income Security Act of 1974 (ERISA) and are therefore regulated by the U.S. Department of Labor (DOL), while the plans are regulated by the state.
MEWAs can offer benefits to employees such as health, dental, vision and life insurance. MEWAs cannot offer benefits that are for the employer such as workers compensation and liability insurance. However, the sponsoring association may offer the employer benefits to its membership while the MEWA trust provides the employee benefits.
Why should you set up a trust?
MEWAs are complicated and can create significant liabilities to the association if they are not set up correctly. Creating a trust limits the liability to the association. It is highly recommended that the association engage legal council to ensure it is following the rules.
Additionally, the DOL requires annual audits from an outside auditor. The trust may also want to market their product. All these services require funds which must be accounted for separately from the operational funds of the association.
The DOL also requires the trust be overseen by trustees, who may be appointed initially, but then later must be elected by the trust’s membership. The trustees are considered fiduciaries and should be covered under fiduciary liability insurance policies.

Asset Solutions Group, Inc., the parent company of the AHP Experts family of companies, was founded in northern Nevada in 1997 as a licensed life and health insurance agency and obtained its first association client in 2000. Since then, we have worked tirelessly to maintain good relationships with our clients and the other competing brokers in the community. We understood from the beginning that, if the other brokers don’t trust us, our associations won’t grow.
That trust paid off. While other associations’ membership growth stalled, AHP Experts clients’ membership grew – because the other brokers trusted that we wouldn’t take their clients. In fact, in the first year AHP Experts began representing one of its builder association clients, that client grew to be larger than the three local competing associations combined.

As AHP Experts began to expand into multiple states, we realized that we needed the trust of the brokers who didn’t already know of our reputation – so we sold our group and individual health business making AHP Experts the only licensed health insurance agency that focuses exclusively on Association Health Plans.
This focus on AHPs 1) allows us to better understand the association market; 2) eliminates any conflict of interest that could occur while representing both an association and individual employer groups; and 3) eliminates any perception of competition with the broker sales force.
Today, AHP Experts holds multi-year contracts with client associations that represent over 30,000 employers in multiple states.

To set up your trust, you will need a trust agreement, summary plan description wrap documents, COBRA notices and more. AHP Experts can recommend attorneys who specialize in MEWAs and have created templates to make the process as simple as possible.
AHP Experts negotiates with insurers on your behalf to create competitive plans with a funding mechanism to cover the costs of attorneys, accountants, marketing and other operations.


How AHP Experts Helps – Long-term, Sustainable Growth
Setting up a MEWA trust takes considerable effort. The last thing we want is a one- or two-year program that implodes because we didn’t set up the plans correctly.
We have watched our competitors negotiate against the insurer to sell a few plans to an association at the lowest possible cost, only to see their efforts disintegrate a year or two later.
AHP Experts works collaboratively with the insurer to create a competitive product portfolio that the brokers want to sell to their clients with a focus on long-term sustainability of the portfolio.
We ensure the trust’s underwriting guidelines include measures that mitigate poor risk to ensure rates don’t balloon in the future.
AHP Experts reviews enrollment monthly to identify brokers new to the association and which brokers are bringing or taking business and we review claims loss data (if provided) to assist in rate negotiation and monitor broker behavior.

AHP Experts works closely with the trustees and the attorney to ensure the contracts with the insurer and third party administrator are compliant.
We provide advice to the association on ways to leverage the insurer’s processes to minimize costs. For example, one of AHP Experts’ clients started to implement its own COBRA notice process. AHP Experts was able to show the association how to leverage the insurer’s COBRA administrator, saving the association $300,000 per year.
AHP Experts assists the trust and insurer in the creation of benefit summaries, employer application and adoption agreements, rate quoting tools, underwriting guidelines, medical assessment forms and informational webpages. We work with the trust and insurer to make products easy for the brokers to compare and sell.


How AHP Experts Helps – Broker Outreach
While other brokers who represent associations take clients from the brokers who bring them business, AHP Experts works with the brokers to grow your association – after all, we don’t sell directly to groups – our only goal is to grow your association!
AHP Experts regularly speaks with brokers who sell our association products. We answer brokers’ questions and help the insurers’ sales teams answer brokers’ questions. We deal with brokers when issues arise and meet with individual brokers and agencies as appropriate.
AHP Experts leads broker meetings at the insurers’ offices and other locations, and we send emails out to all licensed health producers in an association’s state.
When AHP Experts receives a call from a current or perspective member of your association, AHP Experts refers the member to their broker, or if there is no broker, to a broker who is a member of the association.
We recommend that associations do not require the brokers who sell their products be members of the association. While the association can raise meager funds with this requirement, it tends to limit the sales force. Instead, we want your sales force to be as large as possible.
